Welcome to XYZ+ ("we", "us", "our", or "XYZ+"). These Terms of Use ("Terms") govern your access to and use of the website xyzplus.in and any related services (collectively, the "Platform"). By creating an account, placing an order, or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. Eligibility
You must be at least 18 years of age and legally capable of entering into a binding contract under the Indian Contract Act, 1872. By using the Platform you represent that you meet these requirements.
2. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@xyzplus.in of any unauthorised use.
3. Products & Customisation
XYZ+ offers both ready-made apparel and accessories as well as custom-designed products created via our Design Studio. By submitting a custom design you confirm that:
- You own all rights to (or have a valid licence for) the artwork, logos, text and imagery you upload.
- Your design does not infringe any third-party intellectual property, trademark or right of publicity.
- Your design does not contain hateful, obscene, defamatory or unlawful content.
You grant XYZ+ a limited, non-exclusive licence to use, reproduce, and print your uploaded artwork solely for the purpose of fulfilling your order and providing customer support.
4. Orders, Pricing & Payment
All prices are listed in Indian Rupees (₹) and are inclusive of applicable taxes unless stated otherwise. We reserve the right to refuse or cancel any order at our discretion, including (without limitation) for inaccurate product information, pricing errors, suspected fraud, or supply constraints.
Online payments are processed securely through Razorpay. XYZ+ does not store your card details. Cash on Delivery may be available on eligible orders subject to applicable fees and limits shown at checkout.
5. Shipping & Delivery
Estimated delivery timelines are displayed at checkout. Custom products typically require 5–10 business days of production before dispatch. Risk in goods passes to you upon delivery. XYZ+ is not responsible for delays caused by courier partners, weather, strikes, or other events beyond our control.
6. Returns, Refunds & Cancellations
Returns and refunds are governed by our separate Refund & Returns Policy. Please review it carefully — custom-designed products are generally non-returnable except in cases of manufacturing defect or damage in transit.
7. Loyalty Points & Referrals
Loyalty points earned on the Platform have no cash value, cannot be transferred, and may expire as per the rules published in your account. Referral bonuses are credited only after the referred friend completes a valid first order. XYZ+ reserves the right to reverse points found to be earned through fraud or abuse.
8. Designer Marketplace
Independent designers who publish artwork on the Platform earn a commission on each sale per the rates set out in the Designer Dashboard. Designers are solely responsible for the originality and legality of submitted artwork, and indemnify XYZ+ against any third-party claims arising therefrom.
9. Intellectual Property
The XYZ+ name, logo, design system, photographs, and all original Platform content are the exclusive property of XYZ+ Apparel Pvt. Ltd. You may not copy, reproduce, scrape, or commercially exploit any portion of the Platform without our prior written permission.
10. Prohibited Conduct
- Reverse engineering, scraping, or interfering with the Platform's normal operation.
- Uploading malicious code, viruses, or attempting unauthorised access.
- Misusing coupons, points, or referral codes.
- Impersonating any person or entity.
11. Limitation of Liability
To the maximum extent permitted by law, XYZ+ shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of the Platform. Our aggregate liability for any claim shall not exceed the value of the specific order giving rise to the claim.
12. Governing Law & Disputes
These Terms shall be governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the competent courts in Kolkata, West Bengal. The parties will first attempt good-faith resolution via email at support@xyzplus.in.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email or via a notice on the Platform. Continued use after the effective date constitutes acceptance.
